Preamble

 

Website  www.christina-paris.com  (hereinafter referred to as the “Site”), is published by JELIC SARL, whose registered office is located at 66 AVENUE DES CHAMPS ELYSEES, 75008 PARIS.


Identified with the RCS of Paris under the number 447 820 150 00046.

The Customer hereby formally declares that he is an individual, natural person, non-professional or trader, that he is of age or has parental authorization and that he has full and entire legal capacity to contract and perform an online order on the site

These general conditions of sale govern the contractual relationship between JELIC SARL and its customer, both parties accepting them without reservation. These general conditions of sale will prevail over all other conditions appearing in any other document, except prior, express and written derogation.

 

JELIC SARL reserves the right to adapt or modify these General Conditions of Sale at any time. Article I - The product

 

In accordance with Articles L. 111-1 and L. 111-3 of the Consumer Code, the essential characteristics and prices of the products offered for sale by JELIC SARL are available on the Site.

JELIC SARL takes the greatest care in the presentation and description of its products to best satisfy the Customer's information. However, it is possible that non-substantial errors may appear on the Site, which the customer acknowledges and accepts. The information is provided for information only.

Similarly, the photographs on the Site are not contractual.

 

Article II - The order

 

Order taking on the Site is subject to compliance with the procedure set up by JELIC SARL, embodied by a succession of different steps that the Customer must imperatively follow to validate his order. The Customer will have the possibility, before definitively validating his order, to check the details of it and its total price, and to correct any errors, before confirming it to express his acceptance.

Any order confirmed by the Customer constitutes a sales contract and acceptance of all the stipulations herein.

In accordance with article L. 122-1 of the Consumer Code, JELIC SARL may refuse any order from a Customer if it is abnormal, placed in bad faith or for any other reason, in particular if there is a dispute with the Customer or an incident relating to the payment of a previous order or which would contravene the provisions hereof. In this case, JELIC SARL will inform the Customer by e-mail. If the Customer fails to correct erroneous or contrary elements to these GCS, JELIC SARL reserves the right not to process his order.

We reserve the right to refuse an order for a legitimate reason, such as in the following cases:

• The item ordered is no longer in stock.
• We were unable to obtain payment authorization.
• An error has been identified in the information relating to the product, including with regard to the price or a promotion.
• If we suspect fraudulent activity.


JELIC SARL undertakes to honor within the limits of available stocks and in the event of unavailability to inform the customer by any means whatsoever, within 2-5 days (excluding weekends and public holidays) of the order. .

However, we inform you that this preparation period may be extended in the event of a high period of activity. In the absence of availability of the item(s) ordered, JELIC SARL undertakes to reimburse it(these).  

 

Article III - Price and terms of payment

 

1 - PRICE DETERMINATION  

 

The price of the products sold on the Site is indicated respectively by article and reference. The prices of the products are indicated in euros, all taxes included, excluding participation in shipping costs, for France and the countries of the EEC.

 

The total price of the order is indicated at the payment stage.


JELIC SARL reserves the right to modify its prices at any time. The products will be invoiced on the basis of the prices in force at the time of the recording of the order, subject to availability.
The period of validity of the offers and prices is determined by updating the Site.
JELIC SARL will not reimburse any price difference between the time the order was placed and a subsequent price drop.

 

2 - PAYMENT TERMS  

The products are payable in cash on the day of the actual order.

 

  Payment for purchases is made:

-By credit card bearing the CB symbol.

Online STRIPE allows you to pay via a bank server in a secure environment. The order validated by the customer will only be considered effective when the bank payment centers concerned have given their agreement. JELIC SARL implements all means to ensure the confidentiality and security of data transmitted on the Site.

 

- PayPal: This solution allows you to pay online without communicating your financial information during the transaction, these are protected and encrypted. You have the possibility to make your purchases by entering only PayPal email and password or to pay directly with your credit card without creating an account. In case of cancellation of the order, the PayPal account will be automatically credited. The data recorded and kept by JELIC SARL constitutes proof of the order and of all past transactions. The data recorded by the payment system constitutes proof of financial transactions.

 

3 - FIGHT AGAINST FRAUD

JELIC SARL reserves the right to check the validity of the payment, before shipping the order, by any means it deems necessary (including identity documents, proof of address, etc.).  

 

Article IV – Delivery

 

The Customer chooses one of the delivery methods offered on the Site when placing the order:

 

The shipment is made to the delivery address indicated by the Customer when ordering, it being specified that this must be the residence or work address of the Customer or of any other natural person of his choice. Delivery cannot be made to PO boxes.
The amount of delivery costs depends on the amount of the order and the delivery method chosen by the Customer. The amount of the delivery costs is indicated to the Customer before the validation of the order.

So that the delivery times can be respected, the Customer must ensure that he has communicated to JELIC SARL, before the validation of his order, exact and complete information concerning the delivery address (such as, in particular and without limitation street number, building number, staircase number, access codes, names and/or intercom numbers, specific delivery instructions, etc.).
For the range
  Colissimo the times indicated are indicative, they correspond to the average processing and delivery times. For Chronopost, the carrier undertakes to deliver within 24 working hours, provided that the contact details provided are exact and complete.
Deliveries are made on weekdays (excluding Sundays, public holidays, strikes and bad weather).
The times indicated are indicative times, corresponding to the average processing and delivery times. JELIC SARL cannot be held responsible for the consequences due to a delay in delivery that is not its fault.

All orders placed on www.christina-paris.com are intended for the personal use of customers. Customers or recipients of the products are prohibited from any partial or total resale of the products. JELIC SARL de facto disclaims any legal liability if the payment of taxes was not made by the customer.


RELAY PACKAGE

Your package is delivered to you at a merchant near your address. 4200 merchants of the PICKUP network, near your home, your place of work or vacation, to which you wish to have your delivery delivered.
You will be informed of the availability of your package by email. You have 10 working days to pick it up. After this time your parcel will be returned to sender.


COLISSIMO
Your package is delivered to you in person or delivered to your mailbox. If its size does not allow delivery to a mailbox, it will be made available to you at the post office to which you are attached. You have 10 working days from the arrival of your package at the post office to collect it. After this time, it will be returned to us.

INTERNATIONAL COLISSIMO
In case of absence, a distancing notice is left in the recipient's mailbox, it indicates the coordinates of the post office where to collect the package.
The recipient has 15 consecutive days to recover it, after this period, the package will be returned to us. Upon receipt, a refund will be made, the customer will be notified by email.
Customs charges are the responsibility of the customer.

CHRONOPOST
The carrier undertakes to deliver within 24 working hours (excluding weekends and public holidays), once the order has been received (in metropolitan France).

The Customer is required to check the condition of the packaging as well as the products upon delivery. In the event of a damaged package (already opened, missing products, etc.), the Customer undertakes to notify the carrier and JELIC SARL of all its reservations within 48 working hours of receipt of the product by email to:

The customer has 48 hours to declare the anomalies observed, otherwise, no action can be considered against the carrier in accordance with article L. 133-3 of the Commercial Code.
Always check your package upon arrival. If you wish to make reservations with the carrier in the event of missing items or damage, you can contact Chronopost consumer service on 09 69 391 391.


UPS
The carrier undertakes to deliver the package before 7 p.m. for any order taken care of by their platform before 2 p.m. (excluding weekends and public holidays). The delivery time for Corsica is 72 hours.
You will be able to track the delivery of your order by logging on to www.ups.com with the tracking number in the shipping email.
The customer has 10 days to withdraw his package. After this time, it will be automatically returned to us.

 

The deadlines for each carrier are as follows:

 

Relay points: 4 to 8 days depending on the opening hours of the relay point

Colissimo domicile: 2 to 5 working days (Monday-Friday)

Chronopost: 1 to 2 in Metropolitan France (excluding weekends and public holidays) 

Chronopost international: 5-12 days depending on destination

UPS Outside France: 2-7 days depending on destination

 

Article V - Right of withdrawal

 

The legal right of withdrawal and the "satisfied or refunded" guarantee do not apply to articles made according to specific customer requirements or to clearly personalized articles.

In accordance with the provisions of Article L. 121-21 of the Consumer Code, the Individual Customer has a right of withdrawal which he may exercise without reason within fourteen (14) clear days from delivery. of the order which will be exercised by the return at its expense of new products (in their original packaging, unworn, unwashed). 

The Customer must send an email to customer service: contact@christina-paris.com , specifying the order number as well as the references of the returned products.

Items returned incomplete, damaged, worn or soiled will not be taken back.

The returned item will be refunded to the customer within a maximum period of thirty days from its receipt by JELIC SARL. It is up to the customer to keep any proof of return, namely a return by registered parcel or by any other means giving a certain date to its dispatch.

The refund will be made by crediting the amount to be refunded to the customer's bank account debited during the transaction, or by a credit note (excluding postage and return costs).

For countries outside the EEC, please specify to the customs services that this is a return for non-compliance. 

Items returned incomplete, damaged, damaged, damaged or soiled by the customer will not be refunded.

Article VI – Reimbursement

 

The customer has 14 days after receipt of the package to return the item(s) ordered.

The item(s) must be returned on time, as is (unworn, unwashed, unaltered) with their original label(s) and packaging to the following address:

Reimbursement will be made using the same method of payment chosen by the Customer at the time of his order.

The returned item will be refunded to the customer within a maximum period of thirty days from its receipt by JELIC SARL.
The return costs as well as the risks associated with the return of the product are expressly the responsibility of the Customer, who acknowledges and accepts it by adhering to these GCS.
For countries outside the EEC, please specify to the customs services that this is a return for non-compliance.

Items returned incomplete, damaged, damaged, damaged or soiled by the customer will not be refunded.


No exchange is made, the items are refunded. The customer is invited to place a new order.  

 

Article VII – Warranties

 

In any case, JELIC SARL cannot be held responsible for non-compliance with the regulations and laws in force in the receiving country.

 

 

The stipulations of these GCS are without prejudice to the legal guarantees, and in particular the guarantee against hidden defects referred to in articles 1641 and following of the Civil Code.

 

Articles L.211-4 of the Consumer Code: 

“The seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when this has been charged to him by the contract or has been carried out under his responsibility. »
Article L.211-5 of the Consumer Code:
“To be in conformity with the contract, the good must:

- Correspond to the description given by the seller and possess the qualities that the latter presented to the buyer in the form of a sample or model;

Article L.212-12 of the Consumer Code: “The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods. »
Article 1641 of the Civil Code: "The seller is bound by the guarantee on account of the hidden defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer does not would not have acquired, or would have given only a lesser price, if he had known them. »
Article 1648 para. 1 of the Civil Code: “The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect. »
 

 

Article VIII – Duration

 

These T&Cs apply for the entire duration of the online services and products offered by JELIC SARL.  

Article IX - Applicable law

 

Any order automatically entails the customer's acceptance of the T&Cs.
These T&Cs are governed by French law.
In the event of a dispute, only the French courts will have exclusive jurisdiction.

It is recalled that as a general rule, subject to the discretion of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors his financial commitments to the seller.

Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will first contact the company to obtain an amicable solution.

Article X - IT provisions and freedoms

The information collected by JELIC SARL during an order from the Customer is necessary for the management of the transaction and, for this purpose, may be communicated in whole or in part to the service providers of JELIC SARL involved in the execution of the order. .
The Customer is informed that this same personal data may also be collected by an organization in charge of analyzing orders and combating credit card fraud.
In accordance with the provisions of law n° 78-17 of January 6, 1978 known as "Informatique et Libertés", the processing of personal information relating to customers has been declared to the National Commission for Computing and Freedoms (CNIL). The customer has (article 34 of the law of January 6, 1978) a right to access, modify, rectify and delete data concerning him, which he can exercise with JELIC SARL.

Article XI - Retention and archiving of transactions
